Public Charitable Trust

A Public Charitable Trust is a legal entity created to serve the wider public interest by undertaking philanthropic activities. Unlike a family trust, which benefits specific individuals, a public charitable trust is established for the well-being of a larger community. Sumana Trust, for example, is dedicated to providing long-term care and support for individuals with mental health challenges, ensuring continuity of care even after the passing of their parents.

The key purpose of such trusts is to pool resources to achieve a social mission. Public charitable trusts operate transparently, ensuring that their activities align with their stated objectives, offering structured and sustainable support to those in need.

A Private Family Trust is a legal arrangement where a Settlor establishes a trust by initially contributing a basic amount (e.g., ₹10,000) and later transfers additional assets such as property, investments, or cash. These assets are managed by a trustee, who may be a family member, relative, professional, or corporate entity, ensuring the settlor’s wishes are carried out as per the trust deed. The beneficiaries—usually family members or other designated individuals—receive financial benefits from the trust.

The primary objective of a family trust is to protect and manage family wealth, ensuring a smooth transition of assets across generations. It also provides continuity of financial support for individuals with special needs. While the settlor relinquishes direct ownership of the assets, they may retain control over how they are distributed, either by generating income for the beneficiaries or allowing access to the trust’s assets (corpus) under specific terms.

A Will, also known as a “last will and testament,” is a legal document that outlines how a person wishes their assets and property to be distributed after their death. It essentially serves as a roadmap for transferring assets and can also include provisions for managing the estate, naming executors, and appointing guardians for minor children or children with disability.

Q 1. What is the model for Governance of PwMI?

The concept of PwMI Care is based on a Governance Model by establishing two Trusts namely, Sumana Trust, a public charitable Trust and an individual PwMI Beneficiary Trust. Thus, it is blend of institutionalized management of care of the PwMI with the active participation of the parents of the PwMI.

Q 2. What are the two Trusts that are being formed and why they are necessary?

Sumana Trust is a Public Charitable Trust that is established with the main purpose of providing residential, recreational, training facilities in terms of infrastructure creation and its maintenance and medical treatment assistance, as well as spelling out policies to be followed by the Sumana Trust and oversee the governance of PwMI Beneficiary Trusts as spelt out in this document.

PwMI Beneficiary Trust is a Private Trust, created solely for the benefit of the individual PwMI. This trust is created by the Parents of the PwMI to ensure that adequate funds are available for the PwMI when they are there and also after their demise. It is therefore imperative, that each PwMI residing in the community has an individual beneficiary trust created for his or her benefit. Since, the beneficiary trust is a private trust, parents can be rest assured that the money bequeathed to their PwMI will be solely used for their benefit. The trustees thus appointed will ensure the same.

Sumana Trust is a public trust formed for the purpose of providing Lifetime Care of PwMI. M/s Shanders Pvt Ltd are the builders of their gated community where SSIL is located .This gated community is approved by BDA. Beneficiary Families of PwMI need to buy/rent the housing directly from M/s Shanders Pvt Ltd for their dwelling .
